The prosecution in the case of the alleged fake encounter of Lakhan Bhaiyya suffered a setback on Tuesday after the court admitted a defence objection saying that according to Section 32 of the Criminal Procedure Code, the statements made by a person who is now deceased can't be considered as evidence.
